One way consumers can try to seek monetary restitution as a result of a consumer complaint is to file a small claim in the District Court of Maryland. Small Claims Court cases are treated less formally than other cases. They are decided by a judge, not a jury. Simplified rules of evidence and procedure in small claims cases make it easier for individuals to represent themselves. You can still choose to hire or consult with an attorney if you wish. To be tried as a small claim in District Court, your case must meet all three of these criteria: 1. Your claim is for money only, (not the return of property or performance of a service); and, 2. Your claim is for $5,000 or less.
If your case meets all of these criteria, you can consider filing a small claim. The Maryland Judiciary website has a step by step guide to filing a small claim, including forms you will need and a schedule of court fees. The web address for the Maryland Judiciary step by step guide is: http://www.courts.state.md.us/district/forms/civil/dccv01br.html The District Court of Maryland is divided into 12 districts.
